1. Introduction

Welcome to Indigo Tours ("we", "us", "our"). We are a travel and tour operator based in Kalutara South, Sri Lanka. These Terms and Conditions ("Terms") govern your use of our website (indigotours.lk) and the travel services we provide, including but not limited to tailor-made itineraries, guided day trips, private transport, and accommodation bookings ("Services").

By booking a Service with us or using our website, you agree to be bound by these Terms.

2. Our Services

Indigo Tours specializes in creating personalized Sri Lankan travel experiences. Our Services include:

  • Tailor-Made Itineraries: Custom-designed tours based on your interests, budget, and timeframe.
  • Guided Day Trips: Single-day excursions with professional guides.
  • Private Transport: Provision of air-conditioned vehicles and professional drivers for tours and transfers.
  • Accommodation Booking: Arranging stays at guesthouses, hotels, or resorts as part of a tour package.

All descriptions, itineraries, and photographs on our website are for illustrative purposes. The actual tour may vary slightly.

3. Booking and Payment Process

Booking Inquiry: To book a Service, you must complete our "Quick Inquiry" form, contact us via email (info@indigotours.lk), or message us on WhatsApp (+94 77 17 444 61).

Confirmation: A booking is not confirmed until we have received your agreement on the proposed itinerary and you have paid the required deposit. We will send you a formal booking confirmation via email.

Deposit: A refundable deposit of 30% of the total tour price is required to secure your booking.

Final Payment: The outstanding balance must be paid in full 45 days before the start of your tour or upon arrival in Sri Lanka before the tour commences. Failure to pay the balance by the due date may result in the cancellation of your booking.

Payment Methods: We accept payments via only bank transfers. Any bank charges or processing fees are the responsibility of the customer.

4. Cancellations and Refunds

a) Cancellation by You (The Customer):

If you need to cancel your tour, you must notify us in writing (email). The following cancellation charges will apply, calculated from the date we receive your written notification:

  • 45-30 days before arrival: Loss of deposit.
  • 30-15 days before arrival: 50% of the total tour cost.
  • Less than 14 days before arrival or no-show: 100% of the total tour cost.

We will try to refund any recoverable costs (e.g., accommodation or activity fees that have not yet been paid by us) on a case-by-case basis. We strongly recommend you purchase comprehensive travel insurance to cover cancellation fees.

b) Cancellation by Us (Indigo Tours):

We reserve the right to cancel your tour in the rare event of circumstances beyond our control (e.g., natural disasters, political instability, "Force Majeure"). In such cases, we will offer you the choice of:

  1. A full refund of all payments made to us.
  2. An alternative tour of comparable standard, if available.

We are not responsible for any incidental expenses you may have incurred, such as visa fees, vaccination costs, or non-refundable flights.

5. Customer Responsibilities

  • Travel Insurance: It is not a mandatory condition for booking, but we strongly recommend you to have comprehensive travel insurance. It should cover (but is not limited to) medical emergencies, personal injury, trip cancellation, and loss of baggage.
  • Passports & Visas: You are responsible for ensuring you have a valid passport (with at least 6 months validity from your departure date) and have obtained the necessary Electronic Travel Authorization (ETA) or visa for entry into Sri Lanka. https://eta.gov.lk/slvisa/visainfo/apply.jsp
  • Health & Fitness: You must inform us of any medical conditions or dietary requirements at the time of booking. Our tours may involve walking, climbing, and travel in remote areas. You confirm that you are fit and able to participate in the activities on your itinerary.
  • Conduct: You agree to act respectfully towards local cultures, guides, and fellow travelers. We reserve the right to remove you from a tour at your own expense if your behavior is deemed disruptive, dangerous, or illegal.

6. Our Liability

Indigo Tours acts as an agent in arranging services (e.g., transport, accommodation, guides) with third-party suppliers.

  • We are responsible for ensuring our Services are supplied with reasonable skill and care.
  • We are not liable for any injury, illness, death, loss, damage, or expense resulting from acts of third-party suppliers, government actions, force majeure (e.g., war, strikes, natural disasters), or your own negligence.
  • Our liability shall, in any event, be limited to the total amount paid by you for the specific Service in question.

7. Privacy

We are committed to protecting your privacy. We will only use the personal information (name, email, phone number and psssport number) you provide to us for the purpose of arranging your booking and communicating with you about our Services. We will not share your information with third parties except as necessary to fulfill your booking (e.g., providing your name to a hotel).

8. Governing Law

These Terms and Conditions and any dispute arising from them shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka.
